CreditLiteracyProject.com is operated under agreement with SuccessRoadMapPress, LLC and/or its affiliates (“CLP”, “SRMP”, “We” or “Us”). This Agreement describes the terms and conditions (“Terms”) pursuant to which you may access and use the services provided on CreditLiteracyProject.com (“the Site”). Please read this Agreement carefully as your use of the Site constitutes your binding acceptance of these Terms, including any modifications we may make. Please review the CreditLiteracyProject.com Privacy Policy which also governs your use and interaction with the Site.

About this site:

CLP is a website designed to teach about credit and credit scenarios, we are not a credit repair agency and do not repair credit. We provide information and educational material. Our primary content provider is Patrick Ritchie, author of several books about credit, mortgage and consumer law. We may also provide material from other experts on a case-by-case basis.

Description of Services:

Our services include posting articles and blogs about credit and credit scenarios, selling books and classes, partnering with sponsors to provide online classes and webinars on demand. In some cases we may have memberships available for more in depth group attention.

User Content You Submit:

At times users may submit content via comments on blog posts or by sending information through the Site or via email.

Changes to our Privacy Policy:

The latest effective date is located at the top of the Privacy page. We reserve the right to change the Privacy Policy at any time we deem necessary. Non-material changes and clarifications will take effect immediately. If we make non-material changes, we will indicate at the top of this page the revised Policy’s new effective date. If we make material changes that impact you individually, we will attempt to notify you by email or through notice on the home page of the Site, and will also indicate so at the top of this page. Engage in cyberbullying or tease other users in a manner that could be upsetting.

Intentionally or unintentionally violate any applicable local, state, national or international law.

You agree to behave like a rational law abiding compassionate individual who does unto others as they would have them do unto them (assuming one does not wish harm for themselves) at all times while interacting with others on the Site.

CLP disclaims responsibility and liability for the content and opinions expressed by others on the Site including, but not limited to, content or opinions regarding any products or service mentioned on the Site.

When you use the Site, you may also be using the services of one or more third parties, such as a wireless carrier, mobile platform provider, internet provider, credit card processing, host or server. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.

All written content on the Site is protected by copyright, see below for details of copyright and trademark notices.

Copyright Notice:

All content on the Site has been written, created or compiled by Patrick Ritchie and is being used by copyright agreement. Patrick Ritchie retains all copyright over the material being used by CLP. Images used are either from the public domain, purchased software providing images as part of a software license, or may be from paid memberships to sites providing graphics and video.

On a case-by-case basis other content contributors may be utilized and they retain their copyright over any material or works they agree to have appear on CLP.

Trademark Notice:

We reserve the right to file for trademark and/or trade name protection with the United States Patent and Trademark Office on any mark we have created and use in business on a good or service that we have identified a proper basis for filing a trademark application. Content Submitted or Made Available for Inclusion on the Site:

CLP does not claim ownership of content you submit or make available for inclusion on the Site. Content you submit or make available for inclusion on public areas of the Site; you grant CLP and/or its affiliates the following universal, non-royalty, and non-exclusive license(s), in all jurisdictions as applicable:

“Public Areas” of the Site are those areas available to the general public.

Photos, written words, graphics, audio, or video you submit or make available for inclusion on public areas of the Site, the license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display such content on the Site. This license exists only for as long as you elect to continue to include such content on the Site and terminates at the time you or CLP removes such content from the Site.

Security and Password:

Protect your password and request a new one if it has been breached. Passwords may be reset from time to time as a security and privacy technique.

The Site may contain or offer sweepstakes, contests or other promotions, which may be governed by a separate set of rules that describe the sweepstakes, contest or promotion and may have eligibility requirements, such as certain age or geographic area restrictions, or may not be available where prohibited by law. We will not inspect or disclose the contents of private Communications except with the consent of the sender or the recipient, within the scope of the Electronic Communications Privacy Act, or otherwise required by law, court or government agency order. We may employ automated monitoring devices/plugins to protect ourselves and our users from mass unsolicited communications (“Spam”) and/or other types of electronic communications inconsistent with our practices. Such protections may NOT be 100% effective in all instances, we will not be responsible for any legitimate communication that is blocked, or for any unsolicited communication that is not blocked.

International Use:

The content of the Site is focused on the United State of America; while the Site is accessible worldwide the material is not meant for international audiences and may not apply in any country other than the United States of America.

Termination of Use:

You are free to stop using the Site at any time and/or opt-out of communication. Likewise, CLP and/or its affiliates reserve the right to discontinue a relationship with any user of the Site deemed to be in breach of the Terms of Use, but not limited, if it is determined that other detrimental circumstances may exist. 

Governing Law:

The Site is controlled in the State of Arizona, U.S.A.

You agree that by accessing this Site we are in agreement that the laws and statutes of the State of Arizona will apply to all legal matters, without regard to any conflicts of laws principles, and regardless of jurisdiction of the User. Controllers of the Site are not located in any other State or jurisdiction. Any federal matter would be heard in a court of law located in Maricopa County, Arizona. Each party waives any objection it may now or hereafter have to venue or to convenience of forum.

Statute of Limitations:

You agree that regardless of jurisdictional statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or Terms of Use must be filed within twelve (12) months or one (1) year after such claim or cause of action arose or the agreed statute of limitations set between you the user and us the Site has expired at the twelve (12) month or one (1) year mark and is therefore barred from legal proceedings or arbitration per this agreement. If you disagree do not use the Site.

Copyright and Trademark Complaints:

CLP hereby disclaims any rights to trademarks, service marks, trade names, logos, copyrights, patents, domain names or other intellectual property interests of third parties. Please contact support@creditliteracyproject.com to report potential infringement concerns.

Miscellaneous:

Severability – if any provision or verbiage of the Terms of Use is found to be illegal, void or unenforceable, then that provision shall be deemed severable from the Terms of Use and shall not affect the validity and enforceability of any remaining provisions of these Terms.

Waiver – A provision of these Terms of Use may be waived only by a written instrument executed by the party entitled to the benefit of such provision. The failure of CLP to exercise or enforce any right or provision of the Terms of Use will not constitute a waiver of such right or provision.

Notice – Any notice or other communication to be given hereunder will be in writing and given by facsimile, postpaid registered or certified mail return receipt requested, or electronic mail.

No Agency – Nothing in these Terms shall be construed as making either party the partner, joint venture, agent, legal representative, employer, contractor or employee of the other. Neither the CLP nor any other party to this agreement shall have, or hold itself out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action that shall be binding on the other except as provided for herein or authorized in writing by the party to be bound.

These Terms and Your use of the Site and any products shall be governed by the substantive laws of the State of Arizona without reference to its choice or conflicts of law principles.

Terms Regarding Purchases

Sale and Purchase of Goods and Services:

You are solely responsible for all service, telephone, cellular, internet, cable, data charges and/or other fees and costs associated with your access to and use of the Site and Products, as well as for obtaining and maintaining all telephone, computer hardware, and other equipment required for such access and use.

If you elect to access or use products or services that involve payment of a fee, then you agree to pay, and will be responsible for payment of, that fee and all taxes associated with such access or use. If you provide credit or debit card information to pay for such fees then you hereby represent and warrant that you are authorized to supply such information and hereby authorize Us to charge your credit or debit card on an as needed basis to pay the fees as they are due.

Unless otherwise stated, all fees are quoted in U.S. dollars. If your payment method fails your products or services will be cancelled or postpones until said payment has been made current.

Purchase Price:

Products and services are priced by CLP and its affiliates and are subject to change, any changes will be posted in the shopping cart or you will be notified by email if you are purchasing monthly sponsorships or membership.

Disclaimer of Warranty/Limitation of Liability:

Force Majeure:

Neither Party (“Us” “We” and “You”) shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, zombie apocalypse, act of civil or military authority, uprising, hurricane, earthquake, flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

General:

The laws of the State of Arizona and the United States of America govern these terms and conditions. By accessing the Site you consent to these terms and conditions and to the exclusive jurisdiction of the State of Arizona and/or the United States of America courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of CLP to enforce any of the provisions set out in these Terms of Use and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms of Use or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.

Payment:

Credit card, debit card, money transfer, PayPal funds information that you and credit authorizers provide when you make payments electronically for products or other services via CreditLiteracyProject.com will only be used to process the transactions you request. Checks can be sent to Credit Literacy Project, Attn: Patrick Ritchie, PO Box 12285, Tempe, AZ 85284.

We generally do not charge your credit card until after your order has entered the shipping process except for pre-sale products scheduled to be shipped upon completion. For digital products, until we make the digital product available to you except for pre-sale products scheduled to be sent electronically upon completion.

You may not use the PayPal service for activities that violate any law, statute, ordinance or regulation.

Refunds:

CLP offers users a thirty (30) day money back guarantee on products; user must pay shipping to return any material. Refunds are for the price paid for the product and do not include shipping paid.

Refunds are not possible for any consultations charged on a time basis or live events.

Please note that if we believe that you are abusing our refund policy in our sole discretion, we reserve the right to suspend or terminate your account and refuse or restrict any and all current or future use of the Site, without any liability to you.
